Terms & Conditions - Dial-A-Cheque

Dial-A-Cheque’ is a cash advance service made available by OCBC Bank ( Malaysia ) Berhad to its cardmembers whereby a cardmember may request for cash advance from his/her Credit Card Account on the terms and conditions set out herein.

  1. DEFINITIONS
    1.1 ‘Bank’ means OCBC Bank ( Malaysia ) Berhad including its successors-in-title and assigns.

    1.2 ‘Card’ means any Visa Card or MasterCard or any other card issued by the Bank from time to time to a Cardmember.

    1.3 ‘Credit Card Account’ means the account of the Cardmember maintained with the Bank in relation to the Card.

    1.4 ‘Cardmember’ means a Cardmember holding a basic or supplementary Card.
  2. REQUEST FOR DIAL-A-CHEQUE
    2.1 The ‘Dial-A-Cheque’ service is made available to Cardmembers (but excludes Cardmembers whose Credit Card Account is in default or has been suspended or terminated).

    2.2 The Cardmember may request for a cash advance of a minimum of RM 1,000 and up to a maximum of 80 % of the available balance in his/her Credit Card Account subject to a daily maximum amount of RM 10,000 or such other limit with the approval of the Bank.

    2.3 The Cardmember may request for cash advance through Dial-A-Cheque by calling OCBC Call Centre at 1300 88 5000.
    (a) The approval or rejection of any request for cash advance through Dial-A-Cheque will be at the sole and absolute discretion of the Bank.
    (b) The Cardmember may make more than one request for cash advance through Dial-A-Cheque subject to the terms herein.
    (c) The amount advanced will be disbursed in the form of cashier’s order issued in the name of the Cardmember and sent to the Cardmember’s billing address maintained with the Bank.
    (d) The Bank will not entertain any subsequent instructions to cancel any earlier request approved for cash advance through Dial-A-Cheque.

    2.4 The following fees and charges or such other fees and charges as may be determined by the Bank at its absolute discretion from time to time will be imposed and charged for each request for cash advance made through Dial-A-Cheque :-
    (a) a cash advance fee of 5 % on the amount advanced or RM 15 , whichever is higher;
    (b) interest at the rate of 18 % per annum on the amount advanced calculated on a daily basis; and
    (c) a courier fee of RM 5.00 for the delivery of the cashier’s order to the Cardmember.

    2.5 The cash advanced, interest, fees and charges shall be charged to the Credit Card Account of the Cardmember and be reflected in the Cardmember’s next statement once the Bank has approved the Cardmember’s request for a cash advance.
  3. CASHIER’S ORDER
    3.1 All amounts advanced through Dial-A-Cheque will be disbursed in the form of cashier’s orders.

    3.2 The cashier’s order is valid for payment within the time specified on the cashier’s o rder after which payment will no longer be made by the Bank.

    3.3 A Cashier’s order which is cleared outside of Kuala Lumpur , Selangor, Perak, Melaka, Seremban or Pahang will be subject to an outstation cheque fee at 0.03 % of the face value of the cashier’s order subject to a minimum of RM 0.50 or such other amount as may be imposed by the Bank.

    3.4 In the event a cashier’s order (“the original cashier’s order”) is destroyed, lost or not received by the Cardmember, the Cardmember may call OCBC Call Centre or write to the Bank to request for the cancellation of the original cashier’s order and, if required, request for another cashier’s order to be issued in replacement of the original cashier’s order. Any new cashier’s order issued at the Cardmember’s request will be issued on the following conditions :-
    (a) that the Cardmember irrevocably and unconditionally indemnifies the Bank and to keep the Bank indemnified against all demands, claims, liabilities, losses, costs and expenses whatsoever which may be incurred and sustained by the Bank in connection with or arising from the Bank complying with the Cardmember’s request and such sums shall be paid to the Bank immediately on demand; and
    (b) if the original cashier’s order is found or received, the Cardmember shall immediately return the original cashier’s order to the Bank.
  4. GENERAL TERMS
    4.1 The Bank’s decision on all matters relating to or in connection with Dial-A-Cheque shall be final and binding on the Cardmember.

    4.2 The Bank shall not be liable to the Cardmember or any party for any loss, damages or costs incurred by the Cardmember arising from or in connection with any damage or destruction to any cashier’s order, any delay or non-delivery of any cashier’s order to the Cardmember or the performance of the services under Dial-A-Cheque.

    4.3 The Bank may, at its sole discretion, vary these Terms and Conditions, suspend or terminate the Dial-A-Cheque programme. For the avoidance of doubt, cancellation, termination or suspension by the Bank of the Dial-A-Cheque programme shall not entitle the cardmember to any claim or compensation against the Bank for any and all losses or damages suffered or incurred by the Cardmembers as a direct or indirect result of the act of cancellation, termination or suspension. Variation of these Terms and Conditions or the variation, suspension or termination of the services may be made by placing in a general notice in one issue of a daily national newspaper, by posting a general notice in any of the Bank’s branch premises or Bank’s website or by incorporating the notice into the Bank’s bank statements sent to the Cardmembers periodically and the notice will take effect from the date set out in the notice and if no date is stated, will take effect from the date of the notice.

    4.4 The Bank shall have the absolute discretion to use agents, service providers, correspondents or other third parties to implement Dial-A-Cheque and the Bank shall be entitled and the Cardmembers irrevocably and unconditionally consent and authorize the Bank to disclose, or use or apply any information relating to the Cardmembers to such persons for this purpose.

    4.5 The Bank shall not be liable for any default due to an act of God, war, riot, strike, terrorism, epidemic, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of the Bank.

    4.6 In no event will the Bank be liable for any loss or damages (including without limitation, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Dial-A-Cheque programme, even if the Bank has been advised of the possibility of such damages in advance, and all such damages are expressly excluded.

     4.7 These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia and the Cardmember hereby submits to the non-exclusive jurisdiction of the courts of Malaysia.

    4.8 The terms in the Cardmember’s Agreement on the use of the Card shall continue to apply. If there is any conflict between these Terms and Conditions and those in the Cardmember’s Agreement, these Terms and Conditions shall prevail in so far as it applies to the Dial-A-Cheque service. In the event of any conflict, discrepancy or inconsistency in the interpretation of these Terms and Conditions in any language, the English version of these Terms and Conditions shall prevail.
