OCBC @ ERA Campaign 2008 Terms and Conditions
1.
OCBC Bank
(Malaysia) Berhad’s (“OCBC Bank”) Duit-Duit OCBC at ERA (“Campaign”) begins on 7
July 2008 and ends on 2 August 2008, both dates inclusive (“Campaign Period”).
OCBC Bank reserves the right to modify (including extending or shortening) the
Campaign Period at its absolute discretion.
2. During the Campaign Period, a truck (“Campaign
Truck”) will make a few stops every day except on Sundays in Malaysia to enable
participants to board and enter the Money Twister Machine for the contest
(“Contest”). The Campaign Truck will make such number of stops at such
time/place and for such duration as OCBC Bank deems fit.
3. A Contest is open to all Malaysian residents and permanent
residents in Malaysia aged 21 years and above, who are in good health and are
principal cardholder of a valid credit card from any issuers. Supplementary
cardholders do not qualify.
Participants must show their national registration identity cards and credit
cards to the satisfaction of OCBC Bank and complete an application form before
they may participate in a Contest.
4.
By completing the application form, a participant declares that he/she:-
i)
is in good physical and mental heath for the Contest, and does not have any
condition(s) which require(s) or is/are receiving any medical attention; and
ii) accepts these Terms and Conditions and the Rules and Regulations for
a Contest (“Rules and Regulations).
5. Participation forms which contains incorrect
information, are incomplete, illegible, altered or disfigured shall
automatically be disqualified.
6.
The following categories of people are not eligible to participate in the
Contest:
i)
Permanent and/or
contract employees of OCBC Bank, its subsidiaries and related companies
(collectively, “OCBC Group”), and their immediate family members; and
ii)
Representative
and/or agents (including advertising and promotion agents) of OCBC Bank and
their immediate family members.
7. A Contestant is allowed such length of time in the Money Twister
Machine as OCBC Bank may announce at the truck stop. OCBC Bank reserves all
rights to vary the length of time allowed at any time. All participants must
abide by the instructions of OCBC Bank personnel at each truck stop, or the
relevant participants will be disqualified from participating in the Contest.
8. During the allowed time in the Money Twister Machine, a Contestant may
grab as many ping pong balls as he/she can with bare hands. After the allowed
time, the Contestant must stop grabbing and step out of the Money Twister
Machine with the ping pong balls which the Contestant has managed to grab and
hold on to in his/her hands and show the ping pong balls to the Judges (as
defined below).
9. Each ping pong ball is colour coded to represent certain amount in
Ringgit Malaysia (“RM”). The colour code and the amount a colour represents will
be as announced at each truck stop. The Judges (as defined below) will inspect
the ping pong balls shown to them by a Contestant pursuant to Clause 8 above,
and decide the total RM amount which the ping pong balls represent.
10.
Prizes will be
delivered to the Winners’ mailing address indicated in the participation form.
Delivery of the prizes may take approximately 8 weeks after the contest date.
11. OCBC Bank reserves the right to substitute the advertised prizes with
prizes of equivalent retail value at its sole and absolute discretion without
any prior notice. Prizes are strictly not exchangeable for other products.
12. If any of the winners are subsequently found to be ineligible
to participate in the Contest or receive the prize conferred, OCBC Bank reserves
the right to forfeit or reclaim the prize and confer the same on such other
winner as may be determined in such manner as OCBC Bank deems fit.
13. In no event will OCBC Bank be liable for any loss or damages
(including without limitation, loss of income, profits or goodwill, direct or
indirect, incidental, consequential, exemplary, punitive or special damages) of
any party including third parties howsoever arising whether in contract, tort,
negligence or otherwise, in connection with the Campaign/a Contest, even if OCBC
Bank has been advised of the possibility of such damages in advance, and all
such damages are expressly excluded.
14. All decisions relating to the Campaign/a Contest
shall be made by a panel of judges constituted by OCBC
Bank (“Judges”). The Judges’ decisions are final, conclusive and binding.
No appeals, disputes of decisions or correspondences will be entertained.
15. All documents submitted for the Campaign/a Contest and photographs of
participant(s) belong to OCBC Bank. By submitting their application forms to
participate in a Contest, participants hereby consent to and agree that OCBC
Bank shall be at liberty to publish their names, pictures, identification card
numbers and city of residence for advertising and publicity purposes.
Participants may be contacted and information in an application form may be used
by member(s) of OCBC Group and/or their business associates for marketing or
promotion of products and services.
16.
OCBC Bank shall not be liable for any
injury
or loss of lives or valuables or any other loss or damage whatsoever or
howsoever suffered or sustained by the customers arising or resulting, directly
or indirectly, in whole or in part, from their participation in this Campaign/a
Contest or from the prize or prizes conferred on them or as a result of any act
of omission on the part of OCBC Bank.
17.
OCBC Bank may, at its sole discretion, amend, vary or add on to these Terms and
Conditions and the Rules and Regulations, suspend or terminate this Campaign/a
Contest without any prior notice to any persons. Amendments, variations or
additions to these Terms and Conditions /the Rules and Regulations or the
variation, suspension or termination of this Campaign/a Contest may be made by
placing a general notice in one issue of daily national newspaper, by posting a
general notice in any OCBC Bank’s branch premises or OCBC Bank’s website or by
incorporating the notice into OCBC Bank’s bank statement sent to the customers
periodically and the notice will take effect from the date set out in the notice
and if no date is stated, will take effect from the date of notice.
18. By
submitting the application form, the participants are deemed to have read,
understood and agreed to be bound by these Terms and Conditions/the Rules and
Regulations and irrevocably authorize OCBC Bank to
disclose, reveal and divulge information regarding their particulars to the
parties involved directly in this Campaign/a Contest.
19. In the event there are any inconsistencies between the English
version of these Terms and Conditions /the Rules and Regulations and (i) the
translation of these Terms and Conditions/the Rules and Regulations in any other
language; (ii) any brochure, marketing, promotional material in English or any
other language, the English version of these Terms and Conditions/the Rules and
Regulations shall prevail.
OCBC CASH FINANCING-i – 30-DAY FREE TRIAL
Terms and Conditions

OCBC Bank
(Malaysia) Berhad’s (“OCBC Bank”) 30-Day Free Trial (“Campaign”) commences
from 5 May 2008 until 31 December 2008, both dates inclusive (“Campaign
Period”).

This 30-Day
Free Trial is open to all applicants (“the Eligible Applicant”) of Cash
Financing-i (“Facility”) with a gross monthly income of RM2,000-00 and whose
applications for the Facility are submitted through any OCBC Bank branches
in Malaysia and Direct Sales during the Campaign Period and approved on or
before 31 December 2008. Employees of OCBC Bank, it’s related companies,
agents, including advertising and promotion agents, and the immediate
families of the foregoing are not eligible to participate in the Campaign.

Upon the
approval of an application, OCBC Bank will disburse the Facility, the
disbursed amount as confirmed in the Welcome Letter (as defined in and forms
part of the terms and conditions for OCBC Cash Financing-i (“General T&N”)),
into the nominated Eligible Applicants’ savings or current account with OCBC
Bank or other banks in Malaysia.
Takaful contribution for
permanent disability and death will be deducted upon disbursement of
financing. The first instalment will not be deducted on disbursement and to
this extent, Clause 3 of the General T&C
shall not
apply.

From the date of
disbursement of the Facility (“Disbursement Date”), the Eligible Applicant
enjoys a 30-day zero charge period, during which the Facility may be fully
settled by the Eligible Applicant by paying to the Bank the Sale Price (as
defined in the General T&C) only. Once the Bank has received the Sale Price
in full, Syarikat Takaful Malaysia Berhad will refund the entire amount of
the Takaful contribution deducted. The early settlement charge referred to
in the General T&C shall not apply for this 30-day zero charge period.

The 30-day zero charge
period is only offered once per Eligible Applicant.

If you choose to
continue with the Facility by not settling in full the Facility within the
30-day zero charge period, the first instalment is to commence on the first
(1st) day of the calendar month immediately after the 30-day zero
charge period and the subsequent instalments are to be paid on the first (1st)
day of each succeeding calendar months until the Sale Price is fully
settled.

OCBC Bank
reserves the right to reject any application form it deems illegible,
unclear, incomplete and/or not accompanied by the required documents.

The
applicant authorises OCBC Bank to conduct credit checks and verify
information given by the applicant (including without limitation with any
credit bureau, organisation or corporation set up for the purposes of
collecting and providing credit of other information) relating to the
applicant. The application is subject to applicant’s information being
matched with available credit reports. In the event that the information
varies, OCBC Bank
may decline or
may request
for
verification of the documents or information stated above and additional
documentation where deemed necessary
for this application. It need not provide any reason or justification for
its decision.

Processing
of an application is subject to the operation of the system and availability
of the credit checking system. Processing of an application and time
required for disbursement of Facility shall further be subject to time and
date specified or required from time to time by the Bank as cut-off time and
date for submission/receipt of application, documents, and/or information.
10.
OCBC Bank
reserves the right at its absolute discretion to
cancel, terminate or suspend this Campaign in whole or part, at any time and
without prior notice. For the avoidance of doubt, cancellation, termination or
suspension by OCBC Bank of this Campaign shall not entitle the an applicant to
any claim or compensation against OCBC Bank for any and all losses or damages
suffered or incurred by the applicant as a direct or indirect result of the act
of cancellation, termination or suspension.

OCBC Bank
reserves the sole and absolute discretion to vary or amend the terms and
conditions of the Campaign without prior notice to an applicant and these
Terms and Conditions shall prevail over any of the contents of any
promotional materials advertising this Campaign.

Subject to
the extent expressly stated in Clauses 3 and 4 of these Terms and
Conditions, the General T&C shall also apply. If there is any conflict
between these terms and conditions and the General T&C, the latter shall
prevail.

Notwithstanding any of these Terms and Conditions, OCBC reserves the
absolute right to reject any application without assigning any reason for
the rejection.

By
participating in this Campaign, eligible applicants agree to be bound by
these Terms and Conditions and decisions of OCBC Bank.

OCBC Bank
shall not be liable for any default due to any act of God, war, riot,
strike, terrorism, epidemic, lockout, breakdown of any utilities and/or
electronic communications/connections/system, failure of any mechanical and
electronic device, industrial action, fire, flood, drought, storm or any
event beyond the control of OCBC Bank.

In no event
will OCBC Bank be liable for any loss or damage (including without
limitation, loss of income, profits or goodwill, direct or indirect,
incidental, consequential, exemplary, punitive or special damages of any
party including third parties) howsoever arising whether in contract, tort,
negligence or otherwise, in connection with this Campaign, even if OCBC Bank
has been advised of the possibility of such damages in advance, and all such
damages are expressly excluded.

Without
affecting the generality of any provisions in these Terms and Conditions,
gift(s), if any, are given without any warranties whatsoever to an applicant
in connection with the Campaign, and on a while-stock-last basis. One gift
per customer only, irrespective of number of applications. Any gift(s) given
shall not be exchangeable for cash or other goods or services unless
otherwise stated in writing by OCBC Bank.
18.
These Terms and Conditions shall be
governed by and construed in accordance with the laws of Malaysia and the
Eligible Applicant agrees to submit to the non-exclusive jurisdiction of the
Courts of Malaysia.
19.
If there is any discrepancy between
the English version of these Terms and Conditions and the translation in any
other languages, the English version shall prevail.
