1. Promotion

    1. OCBC Bank (Malaysia) Berhad (295400-W) ("OCBC Bank") presents the Friend Introduction Promotion ("Promotion") rewarding an Eligible Customer (defined below) for successfully introducing OCBC 360 Account to his/her friend ("Friend") subject to the terms and conditions herein.

    2. This Promotion will commence on from 17 November 2016 until 31 January 2017, (both dates inclusive, "Promotion Period"),or such other date(s) as may be determined at the sole and absolute discretion of, and as notified to Eligible Customers by, OCBC Bank for the relevant product(s) offered in this Promotion.

  2. Eligibility

    1. Participation in the Promotion is by invitation only. OCBC Bank will send the invitation by an electronic direct mailer ("eDM") with the subject "Friend Introduction Promotion" to existing customers who maintain an OCBC 360 Account with OCBC Bank. For clarity, customers whose account(s) with OCBC Bank and/or OCBC Al-Amin Bank Berhad (818444-T) ("OCBC Al-Amin") have been suspended or terminated or who have breached any other agreements with OCBC Bank and/or OCBC Al-Amin any time within the Promotion Period are not eligible to participate or to continue to participate in this Promotion, notwithstanding such customers' receipt of the invitation eDM. A customer who receives the invitation eDM and is not disqualified will be referred to as an "Eligible Customer".

  3. Promotion Mechanics

    1. An Eligible Customer shall do the following within the Promotion Period when introducing a Friend to OCBC Bank:

      Step 1 Upon receipt of the invitation eDM from OCBC Bank, the Eligible Customer must obtain each Friend's express consent to submit his/her full name and valid mobile number ("Friend's Data") to OCBC Bank, subject to clause 3.3 below.
      Step 2

      The Eligible Customer has to click on the link in the invitation eDM which will redirect him/her to the Promotion site at [www.ocbc.com.my/mgm], where he/she shall, subject to clause 3.4 below:

      (a) register for the Promotion by entering the Eligible Customer's full name, valid mobile number and new IC number; and

      (b) submit his/her Friend's Data to OCBC Bank,

      Step 3 Introduce OCBC 360 Account to the Friend by sending a message ("Introduction Message") by means of short message service, WhatsApp or electronic mail from the Eligible Customer to the Friend

    2. After the Eligible Customer has fulfilled all the steps in clause 3.1 above, his/her introduction of a Friend is considered successful only if all the below criteria are fulfilled by that Friend within the Promotion Period ("Successful Introduction"). For each Friend who has completely fulfilled all the criteria in this clause 3.2 to OCBC Bank's absolute satisfaction, that counts as 1 Successful Introduction. OCBC Bank's records and decisions shall be final, conclusive and binding on all parties concerned.

      (a) The Friend clicks acceptance of the Introduction Message, provides the information required and confirms agreement with the Declaration and Agreement, including giving permission for OCBC Bank to disclose to the Eligible Customer the Friend's account information only to such extent sufficient to determine the Eligible Customer's entitlement to the Friend Bonus Interest (defined below) under these terms and conditions.
      (b)

      The Friend applies and is accepted by OCBC Bank to open an OCBC 360 Account within the Promotion Period provided that :

      • All applications are subject to OCBC Bank's sole and absolute discretion. If a Friend is not accepted by OCBC Bank to open the OCBC 360 Account for whatever reason, this criterion is deemed not fulfilled.

      • The Friend has never opened any OCBC 360 Account in the 12 months preceding the introduction, otherwise this criterion is deemed not fulfilled.

      • If the Friend opens the OCBC 360 Account jointly with another, the Friend must be named as the primary accountholder failing which this criterion is deemed not fulfilled.

      • If an Eligible Customer introduces 2 or 3 Friends who open 1 OCBC 360 Account jointly with each other, then the Eligible Customer is deemed to have successfully introduced only 1 Friend.

      • If OCBC Bank receives a Friend's Data from more than 1 Eligible Customer and the Friend accepts more than one Introduction, then the Eligible Customer who submits that Friend's Data first in time in accordance with these terms and conditions, will be deemed to have introduced the Friend for purposes of the Promotion. All other Eligible Customer(s) who submit the same Friend's Data subsequently will be deemed not to have fulfilled this criterion.

      (c)

      The Friend deposits a minimum of RM500 into the OCBC 360 Account within 21 calendar days from account opening.

    3. Before submitting the Friend's Data to OCBC Bank, the Eligible Customer shall :

      • obtain the Friend's express consent for the Eligible Customer to submit the Friend's Data to OCBC Bank for purposes of participation in the Promotion subject to these terms and conditions;

      • inform the Friend that OCBC Bank will contact the Friend to fix an appointment to fill in the Friend's application for the OCBC 360 Account;

      • inform the Friend that upon the Friend fulfilling the criteria in clause 3.2 above, these facts will be disclosed to the Eligible Customer for purposes of his/her entitlement to the Friend Bonus Interest (defined below); and

      • inform the Friend that the Friend’s Data will be processed by OCBC Bank in accordance with its privacy policy which is accessible at www.ocbc.com.my.

    4. The Eligible Customer

      • agrees that by registering for the Promotion, OCBC Bank may process his personal data (including but not limited to his full name, mobile number and IC number submitted for registration) for purposes of the Promotion and OCBC Bank may disclose to the Friend that the Eligible Customer submitted the Friend’s Data to OCBC Bank for participation in the Promotion;

      • represents and warrants that the Friend's Data are authentic and belong to a friend who is personally known to the Eligible Customer, that the Eligible Customer has duly performed all the conditions imposed in clause 3.3 above before submitting the Friend’s Data to OCBC Bank; and

      • agrees to and shall indemnify OCBC Bank fully from and against all claims, liabilities, losses, damages, costs, expenses, fees, charges whatsoever and howsoever arising from a breach of this clause by the Eligible Customer.

  4. Friend Bonus Interest

    1. An Eligible Customer will be entitled to receive reward in the form of bonus interest at a maximum of 1% per .annum on the first RM100,000 average daily balance in the Eligible Customer's OCBC 360 Account ("Friend Bonus Interest") for 1 month for each Successful Introduction, subject to the maximum of 3 months for 3 or more Successful Introductions. Accordingly, an Eligible Customer will receive Friend Bonus Interest :

      • for 1 month for 1 Successful Introduction;

      • for 2 months for 2 Successful Introductions; and

      • for 3 months for 3 or more Successful Introductions.

    2. The Friend Bonus Interest will be credited into the Eligible Customer's OCBC 360 Account by the 21st working day of the following month after the Successful Introduction of the Friend. This is further illustrated below:

      The Friend opens an OCBC 360 account on 2 November 2016 & funds it within 21 calendar days i.e. 23 November 2016.
      The Eligible Customer is entitled to the Friend Bonus Interest.

      Assuming that the Eligible Customer's average daily balance in the OCBC 360 Account for November 2016 is RM30,000, then the Friend Bonus Interest is computed as follows :

      1%p.a. x RM30,000 x 30 days/365 days = RM24.66
      The Friend Bonus Interest will be credited by the 21st working day in December 2016 i.e. 30 December 2016.
      B
      The Friend opens an OCBC 360 account on 1 December 2016 & funds it on 4 January 2017.
      The Eligible Customer is not entitled to any Friend Bonus Interest. No Friend Bonus Interest
      C
      The Friend opens an OCBC 360 account on 30th November 2016 & funds it on 7th December.
      The Eligible Customer is entitled to the Friend Bonus Interest.

      Assuming that the Eligible Customer's average daily balance in the OCBC 360 Account for December 2016 is RM75,000, then the Friend Bonus Interest is computed as follows :

      1%p.a. x RM75,000 x 31 days/365 days = RM63.70
      The Friend Bonus Interest will be credited by the 21st working day in January 2017 i.e. 31 January 2017.

    3. The Friend Bonus Interest cannot be exchanged for credit.

    4. No request by the Eligible Customer or any other party to exchange or substitute the Friend Bonus Interest with any other item will be entertained. The Friend Bonus Interest cannot be credited to an account other than the Eligible Customer's OCBC 360 Account.

    5. If the Bank subsequently discovers that an Eligible Customer is in fact not eligible to participate in the Promotion or any of the applicable conditions are not fulfilled, the Bank may at its discretion forfeit the Friend Bonus Interest or reclaim it, if already credited, by debiting the account of the Eligible Customer. For clarity, OCBC Bank shall be entitled to forfeit or reclaim Friend Bonus Interest for all the Successful Introduction(s) if the Eligible Customer is found to have breached or failed to fulfil any of the above conditions in respect of any 1 Successful Introduction. No person shall be entitled to any payment or compensation from the Bank should any Friend Bonus Interest be forfeited or reclaimed.

  5. Other terms and conditions

    1. Participation in this Promotion is deemed acceptance of these terms and conditions.

    2. Notwithstanding anything to the contrary, the Bank reserves the right to reject any Friend Introduction at the Bank's sole and absolute discretion, without giving any reason for rejection.

    3. The Bank reserves the right at its absolute discretion to vary or add to these Terms and Conditions or to suspend or terminate this Promotion. Notice of such variation of the Terms and Conditions or suspension or termination of the Promotion is deemed given by posting a general notice in any of the Bank's branches or its website and the notice will take effect from the date set out in the notice and, if no date is stated, will take effect from the date the notice is sent.

    4. The Bank's decision on all matters relating to the Promotion is final, conclusive and binding on all parties concerned. No appeal or correspondence will be entertained or accepted by the Bank. The Bank shall not be obliged to give any reason or enter into any correspondence with any person on any matter concerning the Promotion.

    5. In the event of any inconsistency between these Terms and Conditions and any application form, brochure, marketing or promotional material relating to the Promotion, these Terms and Conditions shall prevail.

    6. All the existing Accounts and Services – Main Terms and Conditions and OCBC 360 Account Terms and Conditions shall continue to apply. In the event of any inconsistencies or discrepancies, these Terms and Conditions shall prevail only insofar as they are relevant and applicable to the Promotion.

    7. These terms and conditions herein contained shall be governed by and construed in accordance with the laws of Malaysia.
